Terms and Conditions

Introduction

Bid and Win Auction is a product of Bargain Bin & Beyond. These Terms and Conditions ("Terms") govern your access to and use of Bid and Win Auction ("Platform"). By creating an account, accessing the Platform, or participating in any auction, you agree to be legally bound by these Terms.

Eligibility

  • You must be at least 18 years old
  • You must provide accurate and complete registration information
  • The Platform is intended for businesses, including retailers, wholesalers, and resellers, and individual clients purchasing in bulk or participating in wholesale auctions
  • We reserve the right to approve, reject, or suspend accounts at our discretion, including verification of business or purchasing intent where applicable

Account Responsibility

You must notify us immediately of any unauthorized account use. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities conducted under your account
  • Ensuring your personal or business information is accurate and current

Auction Participation

All bids placed on the Platform are legally binding. By placing a bid, you agree to complete the purchase if you are the winning bidder.

Each auction has administrator-configured rules that may include buyer’s premium, bid increments, reserve visibility, Buy Now, fixed or extended closing, payment deadlines, pickup periods, and disclosed fees. These rules are shown before bidding and normally lock when bidding opens.

A submitted bid may be removed only after administrator review of a verified system error, obvious entry mistake, or material listing change. Every approved exception is recorded.

You agree not to manipulate bidding activity, use automated tools or bots, or engage in fraudulent or collusive behavior. Violations may result in account suspension or permanent removal.

Payments

  • The settlement states the administrator-configured payment deadline; the standard resolution period is four calendar days unless the auction disclosure states otherwise
  • Failure to pay may result in order cancellation, deposit withholding where authorized and disclosed, account suspension or restrictions, and removal from future auctions
  • Payments are processed by third-party providers; we do not store full payment details

Shipping and Fulfillment

Shipping and delivery may be handled by third-party transportation companies. Shipping timelines, costs, and terms are determined by the applicable auction disclosures and service providers.

Pickup auctions may include an administrator-configured collection deadline, grace period, storage charge, and missed-appointment fee. Any such charge must be disclosed before bidding and cannot be applied retroactively.

Third-Party Fees Disclaimer

Fees related to payment processing, shipping, taxes, duties, or import charges are determined and charged by third parties, not Bargain Bin & Beyond. We do not control or guarantee these costs.

Order Finality

  • Auction sales are final unless an administrator approves a documented exception
  • Permitted exceptions may include a material discrepancy from the listing, pre-release damage, shortage, non-delivery, verified system error, or mutually approved cancellation
  • Authorized refunds may be full or partial and require a recorded reason
  • Businesses and individuals are responsible for reviewing product details, auction rules, and disclosed fees before bidding

Platform Use Restrictions

You agree not to:

  • Use the Platform for unlawful purposes
  • Interfere with system operations or security
  • Attempt unauthorized access to accounts or data
  • Copy or exploit Platform content without permission

Intellectual Property

All Platform content, including its design, branding, software, and materials, is owned by Bargain Bin & Beyond and protected by applicable intellectual property laws.

Privacy

Your use of the Platform is also governed by our Privacy Policy. You consent to the collection of account, bidding, and transaction data; use of that data to facilitate auctions and transactions; and necessary sharing with vendors, partners, and service providers.

Limitation of Liability

To the fullest extent permitted by law, Bargain Bin & Beyond shall not be liable for indirect, incidental, or consequential damages; loss of profits, business, or opportunities; issues arising from third-party services; or Platform interruptions, errors, or delays.

Indemnification

You agree to indemnify and hold harmless Bargain Bin & Beyond from claims, damages, or liabilities arising from your use of the Platform, violation of these Terms, or participation in auctions or transactions.

Termination

We may suspend or terminate accounts at our discretion and remove bids or restrict participation when violations occur.

Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.

Governing Law

These Terms are governed by the laws of the State of Michigan, United States.
